Terms of service Payment card

Short and to the point, or contribution cards in human terms:

A donation card is a tool that allows you to instantly provide the opportunity to donate to your Dropbox to any person you meet. It is a physical card, received by the Organiser, which resembles an ATM card in appearance and allows the user of most mobile devices to be redirected - via NFC technology and a QR code - to a deposit screen on the cardholder's Dropbox. This means that Supporters will be able to donate to the Organiser anywhere using any available mobile payment method. The service does not involve any specific obligations on the part of the Organiser, the Operator does not charge a commission on the funds accepted, and the Contribution Card is ready to use as soon as it is received. In other words, the Contribution Card acts like a mini-terminal and is linked to your e-wallet (i.e. the Dropbox).

The solution can be useful, for example, for restaurant staff who can use it to accept tips, fundraisers, public fundraisers or entrepreneurs working in the service sector (e.g. coaches, tutors, etc.).

Remember that if the money you accept is subject to certain taxation, it is your responsibility to account to the tax office and pay the tax.

  1. DEFINITIONS
    1. Operator - shall mean Zrzutka.pl sp. z o. o. with its seat at al. Karkonoska 59, 53-015 Wrocław, NIP 8992796896, REGON 365261657, KRS 0000634168.
    2. Organiser - means the User who presents a Project in order to raise funds for its realisation.
    3. Project - means any manifestation of business, cultural, scientific or social activity, as well as private and sales activity, for the realisation of which the Organiser raises funds by means of the Website.
    4. Regulations - means these regulations.
    5. Zrzutka.pl Rules and Regulations - means the rules and regulations of Zrzutka.pl website in its current version, available each time at https://zrzutka.pl/regulamin/.
    6. Service - means the website run under the domain www.zrzutka.pl, and any sub-domains, where the Operator provides electronic services consisting in particular in providing space for the creation of Drops by the Users and mediating in the transfer of funds between Users.
    7. Contribution Card - means a card equipped with NFC technology and a QR code, which enables the Organiser to accept funds from Supporters by means of available payment methods, in particular by means of a payment card and the BLIK mobile payment system. Each card is assigned to a specific Dropbox where the funds collected by the Organiser are collected.
    8. User - means an adult natural person, a legal person or an organisational unit without legal personality which is granted legal capacity by law, using the Website. A natural person using the Service who is at least 13 years of age and has sent the consent of his/her legal representative to use the Service shall also be considered a User.
    9. Supporter - means a User who makes a monetary contribution to a specific Project as part of a Dropbox.
    10. Drop - means the collection of funds by the Organiser within the Service in order to realise a Project.
  2. RULES OF USING THE PAYMENT CARD SERVICE
    1. In order to start using the Contributing Card service, it is necessary to set up a Drop within the Service and to order a Contributing Card in the Organiser's Panel, whereby the Organiser takes further technical steps based on the messages displayed to him/her and the information available on the Operator's website.
    2. The cost of the Payment Card is PLN 29.94 plus shipping costs. The amount covers 6 months of free activity of the Payment Card.
    3. The 6 months of free activity start from the date of ordering the Payment Card.
    4. After the expiry of the 6 months of free activity of the Prepayment Card, the Operator wishing to continue using the service is obliged to pay a subscription fee of PLN 4.99 for each consecutive month of using the Prepayment Card. The fee will be charged automatically by the Operator from the balance of the Dropbox associated with the Contributing Card, except when the balance of the Dropbox is insufficient to cover its amount. In such a case, the Organiser wishing to continue using the Contributing Card should pay the amount of PLN 4.99 by making a transfer in the premium tab of the card.
    5. If the Organiser does not pay the subscription fee, the possibility for the Supporters to make a donation to the Dropbox via the donation link stored on the Contribution Card will be blocked until the amount of the subscription fees is paid. The possibility to make a simple donation to the Dropbox, without the intermediary of the Contribution Card, will remain active. The blocking of the possibility to make contributions via the Contribution Card also does not affect the availability of the funds collected so far to the Organiser, who can make withdrawals.
    6. The cancellation of the use of the Contribution Card can take place at any time. To deactivate a subscription, simply go to the settings of the Contributing Card and select 'cancel subscription' - the card will remain active until the date by which the subscription was paid and will then be deactivated. The card and subscription can be reactivated at any time by clicking 'activate subscription' in the space indicated above.
    7. Each Contributor Card is assigned to one Dropbox. This means that the Organizer, wishing to use the service of the Contributing Card for more than one Drop-off, should pay a fee of PLN 29.94 plus shipping costs for each additional Contributing Card.
    8. The funds collected through the Contribution Card directly fund the virtual payment account of the Dropshipper. Only the Organiser of the Drop-in using the Contributing Card service is entitled to dispose of these funds.
    9. The service of the Payment Card does not constitute a payment service in the meaning of art. 3 section 1 of the Act of 19 August 2011 on payment services (Journal of Laws 2020 item 794). The Contribution Card only enables the Supporters to use the payment methods available for the respective Drop.
  3. FINAL PROVISIONS
    1. These Regulations shall be governed by Polish law and are complementary to the Regulations of Zrzutka.pl, with which they should be read together. For the establishment, conduct, verification and rules of functioning of the Dropshots for which the Organizer will order a Payment Card, the rules of the Regulations of Zrzutka.com shall apply directly.
    2. Operator - Zrzutka.pl sp. z o.o. - acts as a national payment institution, entered in the UKNF Register of Payment Services under number IP48/2019, on the basis of a permit dated 14 October 2019 issued by the Polish Financial Supervision Authority and is subject to the supervision of the Polish Financial Supervision Authority with regard to the payment services it provides.
    3. The Operator reserves the right to unilaterally amend these Terms and Conditions for important reasons, which include changes in legal regulations and economic factors such as a change in the scope of goods and services offered, as well as when the obligation to amend the Terms and Conditions results from a final court decision or a decision of a public authority, subject to the provisions of Appendix No. 3 to the Terms and Conditions of the Service (Framework Agreement) item 14.
    4. The Operator shall inform the Users of amendments to the Regulations by e-mail to the e-mail address provided during registration on the Website. Within 7 days from the date of receipt of information on amendment of the Regulations, the User may submit a declaration on refusal to accept the amended content of the Regulations - such a declaration shall be treated as termination by the User of the legal relationship which is the basis for provision of the Services.
    5. These Regulations shall be binding for the Users from 10 March 2021.
